Your use of this Website or purchase of any items offered on the Website (the "Products") shall be deemed to your agreement to abide by each of the terms set forth below. Rayzr Custom may changed these Terms and Conditions at any time by providing an update on this Website.
1. GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
2. PRODUCT SALES
These Terms and Conditions contain all of the terms and conditions pursuant to which Rayzr Custom Engraving will provide the Products and any services. Any terms and conditions which you include in any purchase order, confirmation of order or other document are expressly excluded. Any variation of these Terms and Conditions will only be binding if agreed in writing by you and an authorized representative of Rayzr Custom Engraving.
3. INNAPPROPRIATE CONTENT
Rayzr Custom Engraving has the sole discretion to reject any order that it considers libelous, defamatory, obscene, profane, advocating persecution based on gender, age race, religion, disability or national origin, containing explicit sexual content or is otherwise inappropriate for Rayzr Custom production.
4. ARTWORK AND LOGO RELEASE
By submitting artwork to Rayzr Custom Engraving for laser imprinting you affirm proper ownership or have secured the rights to reproduce all artwork, clipart, logos or other materials. You also agree to hole harmless Rayzr Custom Engraving from any and all losses, costs expenses and/or damages on any account and all manner of demands, claims, actions and proceedings that may be insstituted against Rayzr Custom on grounds that said imprints violate any copyright and/or any proprietary right of any person or company.
4. ORDERS/SHIPMENTS
All Products are offered for sale subject to availability and subject to our acceptance of your order. Rayzr Custom reserves the right to reject any order for any reason.
Any dates quoted for delivery of Products are estimates only. Rayzr Custom Engraving will not be liable for any loss or expenses sustained by you that arise from any delay in the delivery of the Products.
Rayzr Custom Engraving will arrange for shipment of Products to the customer, Free On Board (F.O.B.) shipping point, meaning title tot the Products and risk of loss passes to the customer upon delivery to the carrier.
5. RETURNS AND REFUNDS
Rayzr Custom Engraving makes every effort to ensure that all orders are filled accurately and on time and are of the highest quality. We cannot accept returns of customized Products that are not damaged or defective upon receipt. You are responsible for inspecting the Products promply upon delivery.
DAMAGE UPON DELIVERY
If the Products are damaged upon delivery, please send a description along with a photo of the alleged damage to information@Rayzr-custom.com within five days of delivery. Rayzr Custom Engraving will assess damage and determine wheter or not a replacement is warranted once the original Products are returned to Rayzr Custom Engraving and reviewed.
6. QUALITY OF CUSTOM MARK
Rayzr Custom Engraving takes great care to ensure the quality of each every customization mark that we produce. Note that we cannot accept returns on orders where a customer has approved the artwork and the Product was customized according to an approved proof.
7. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Rayzr Custom Engraving, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Rayzr Custom Engraving and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
9. PRIVACY POLICY
Rayzr Custom Engraving recongnizes that you have a right to privacy, and we will not give or sell anyone specific information about you or any orders you have placed through the Website except that: (i) Rayzr Custom Engraving may provide information about you and you order to its subcontractors; and (ii) Rayzr Custom may share information about you with its marketing partners and affiliates for purposes of marketing Rayzr Custom.
10. SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
